Punjab RERA directs builder to refund fees and obtain completion certificates


MOHALI: The Real Estate Regulatory Authority (Rera) has mandated a builder to refund Rs 5.45 lakh in excess maintenance charges collected from allottees and to secure the necessary Completion and Occupation Certificates. This decision follows a complaint filed by a residents’ association.

The authority has emphasized that the builder must deliver all promised amenities as per the project’s brochure and refund charges for the excess area.

The complaint was raised by the residents’ welfare association (RWA) of the housing society, citing various deficiencies and non-compliance from the builder. Rera endorsed the residents’ plea, issuing several directives in their favor.

Advocate Mohd Sartaj Khan, representing the complainants, hailed the verdict as a significant victory for allottees involved in the case against the project builder.

Previously, the district consumer disputes redressal commission in Ropar (camp at Mohali) had partially upheld the complaint on February 6, 2026, and issued additional directions.

As per the ruling, the builder is required to obtain Completion and Occupation Certificates and refund the excess maintenance charges collected from buyers until these certificates are obtained.

The commission highlighted that while the complainants paid for a super area of 5,110 sq ft, the actual area delivered was only 4,769 sq ft. The builder is directed to refund charges for the excess 342 sq ft.

Additionally, the builder must pay 12% annual interest on the sale amount from the date of the complaint until the required certificates are obtained. The commission also awarded litigation costs of Rs 75,000 to the complainants, with a 45-day compliance deadline.

The allottees, Col Romesh Ghai and Shaheen Ghai, welcomed the ruling, calling it a decisive win for residents. The case was pursued by advocates Mohd Sartaj Khan and Luv Malhotra under the Consumer Protection Act.
