NEW DELHI: The Uttar Pradesh Real Estate Regulatory Authority (UP-RERA) has introduced an online system for registering complaints against promoters and developers who demand transfer fees exceeding the allowed limits during the allotment transfer process.
Homebuyers and allottees can submit complaints using Form-M on the UP-RERA portal, a feature that became available following the implementation of the 10th amendment to the UP-RERA General Regulations, 2019.
According to the revised Regulation 47(c), promoters are prohibited from creating new or amended agreements for sale or lease with the assignee or successor-in-interest. Transfers must be documented via an endorsement in the original agreement, with updates made to the promoter’s records.
In the event of an allottee’s death, if the successor-in-interest is a family member, the promoter may only charge a processing fee of up to ₹1,000. The successor is required to provide documentation such as the original allottee’s death certificate, a succession certificate from the appropriate authority, and no-objection certificates from other legal heirs.
For transfers or assignments to another family member, the processing fee is similarly capped at ₹1,000. If the assignee or successor is not a family member, the maximum processing fee cannot exceed ₹25,000.
Any demands surpassing the established limits can be contested through the online complaint system.
