Jaipur Developer Seeks SC Action on Residential Land Use

NEW DELHI: A private real estate company in Jaipur has petitioned the Supreme Court, alleging unauthorized commercial activities on land intended for residential use and urging the Jaipur Municipal Corporation (Greater) to investigate and act accordingly.

The petition was filed in the ongoing case of Loganathan vs State of Tamil Nadu & Ors., where the Supreme Court already instructed municipal authorities in state capitals to identify residential areas misused for commercial activities and provide compliance reports.

Rajdarbar Pinkcity Developments Pvt. Ltd. seeks to include its concerns in the Supreme Court’s ongoing review of unauthorized commercial use of residential zones. The company claims to have exclusive development rights over land in Village Chimanpura, Bhankrota, Jaipur district. They allege that various commercial establishments—such as furniture stores, boutiques, salons, eateries, and clothing shops—are operating on this land against its approved residential designation.

The land is slated for a private residential township as per Rajasthan’s Township Scheme, with the Jaipur Development Authority (JDA) acknowledging these development rights since 2005.

In its pleadings, the developer states that despite numerous representations and an order from the Rajasthan High Court urging consideration of its grievances, no effective action has been taken against the unauthorized commercial activities and constructions.

In January 2025, the company approached the JDA Appellate Tribunal for action against these activities, which led to a May 2025 directive for site inspection and potential legal action if violations were found. Subsequently, the company submitted further representations to the Jaipur Municipal Corporation (Greater) and escalated the matter to the Rajasthan High Court.

On February 4, 2026, the Rajasthan High Court instructed local authorities to respond with a reasoned order within two months, but the developer has claimed no decision has been communicated during this timeframe and is exploring additional legal options.

Alongside an application to be heard in the Supreme Court case, the company has also requested the Jaipur Municipal Corporation (Greater) to address the disputed land in its compliance affidavit, following the Supreme Court’s March 25, 2026 order.

The developer seeks the Supreme Court’s direction for the civic authorities to investigate the alleged unauthorized constructions, provide the current land status, and take appropriate actions if any illicit commercial activities are confirmed.
