Delhi Court Cancels Bail of Nivas Promoters’ Director in Fraud Case


NEW DELHI: A Delhi court revoked the bail of a builder accused of defrauding homebuyers in Greater Noida. The court found that he repeatedly violated bail conditions, ignored directives, and exploited the leniency granted.

Judicial Magistrate Ankit Garg listened to the prosecution’s request to cancel the bail previously granted to Rahul Chamola, director of ‘Nivas Promoters Pvt Ltd’, on December 13, 2023.

The court noted Chamola’s behavior indicated a blatant disregard for bail conditions.

In February 2024, he sought exemption from personal appearance, which was granted upon payment of a ₹5,000 fee; however, by October of the same year, he failed to pay the fee.

In April 2025, Chamola was absent, necessitating the issuance of bailable warrants to ensure his presence.

The court remarked, “The ongoing disregard for bail conditions led to this cancellation request. On May 7, 2026, the Investigating Officer (IO) informed the court that efforts to locate the accused were unsuccessful.”

In June this year, although Chamola participated in some investigations, he left midway, and the following month, despite a directive for his physical presence, he appeared only via video conference.

The court emphasized that Chamola consistently ignored the explicit conditions for his bail. The judicial records revealed repeated failures over an extended period, despite leniency shown by consecutive presiding judges.

It was stated that the accused abused the privilege of bail by skipping hearings, compelling the court to issue warrants, providing conflicting address information, and disregarding orders even during bail cancellation considerations.

“Continued and deliberate violations of bail conditions and repeated misuse of the court’s leniency provide valid legal grounds for bail cancellation,” the magistrate noted.

The evidence presented illustrates that despite numerous warnings, fines, and judicial directions spanning over two years, the accused continued to flout court conditions.

Criticizing the behavior, the magistrate stated it “clearly shows an abuse of the leniency afforded by the court.”

He remarked that the accused deliberately and repeatedly violated the conditions set in December 2023, failed to comply with the court’s directives despite multiple chances, and misused the bail concession.

Given Chamola’s conduct, the magistrate stated that there is no reason to believe that further leniency would ensure adherence to the imposed conditions, thus canceling the bail.

Earlier allegations against Chamola included enticing homebuyers into purchasing flats in his ‘Oneleaf Troy’ project in Greater Noida, yet he failed to deliver the properties and misappropriated the advance payments.

According to the complaint, to further deceive potential buyers, he conspired with an individual named Shelendra Sharma to rename the project to ‘Renowned’, which was launched by a group established by Sharma, who is also a co-defendant in another FIR against Chamola.

The prosecution argued that Chamola misled buyers into investing in a project that ultimately remained incomplete, leaving them stranded.
