Bengaluru Housing Crisis Hits Breaking Point


BENGALURU: The Karnataka Real Estate Regulatory Authority (K-RERA) has instructed the Bengaluru Development Authority (BDA) to facilitate the establishment of an Association of Allottees for the Gunjuru Housing Project Phases 1 and 2. This involves transferring common areas and essential title documents to the Association, as per legal requirements.

During proceedings concerning a petition by Narayan Shetty, an allottee, K-RERA emphasized that Phases 1 and 2 of the project are subject to regulation under Section 3 of the Act. The order mandates that the promoter/developer register the project within two weeks and submit an application for an occupancy certificate within 60 days.

K-RERA clarified that the BDA qualifies as a promoter under Section 2(zk), affirming that the Gunjur Housing Project is a real estate endeavor under Section 2(zn) of the Act.

The judgment highlighted the BDA’s lack of response to the notice, noting that they did not contest the claims nor provide any documentation. Therefore, it was concluded that the failure to complete the project and provide amenities is primarily the BDA’s responsibility.

The complainant accused the BDA of failing to provide occupancy certificates, despite the sale deed for the flat being executed on January 18, 2019. Additionally, the BDA has not secured necessary no-objection certificates or provided a permanent electricity connection. Essential facilities, such as the STP, remain non-operational due to electricity issues, and the lifts are not functioning correctly.

Dhananjaya Padmanabhachar from the Karnataka Home Buyers Forum regarded the K-RERA ruling as a critical reminder for the BDA to act promptly in transferring the common area title to the association.
