HYDERABAD: The Ranga Reddy District Consumer Disputes Redressal Commission has ordered a builder in Bowrampet to provide a legally sanctioned car parking space to a flat owner. This ruling follows revelations that the developer had improperly modified the stilt-floor layout of Pinewood Apartments, leading to ongoing disputes among residents.
The complainant, who purchased flat no. 303 for ₹25.91 lakh in February 2022, noted that the sale deed specifically included a car parking slot. Upon moving in, however, he found that the builder had deviated from the HMDA-approved design. The initial plan allowed for 10 car parking spaces with two driveways, but the builder changed the design to fit 12 cars and eliminated one driveway. This alteration caused confusion and disputes, including an incident where another resident confronted and verbally abused him for using the originally designated parking spot.
Even after issuing an allotment letter to another resident, the builder neglected to allocate a parking slot to the complainant and denied making any illegal changes. The commission, however, uncovered documentary evidence that confirmed the deviations. The ruling stated: “Adjusting an approved plan and selectively allocating parking spaces signifies a substantial deficiency in service and infringes upon the buyer’s lawful rights.”
The builder has been instructed to assign the complainant a parking slot per the approved layout and is required to pay ₹20,000 in compensation and ₹5,000 in legal costs within 45 days.
