HC Questions LDA & LMC’s Plans for Sahara Land

LUCKNOW: On Thursday, the Lucknow bench of the Allahabad High Court inquired about the actions proposed by the Lucknow Development Authority (LDA) and the municipal corporation regarding the land reclaimed from Sahara India Commercial Corporation Limited in Gomtinagar.

The court emphasized that this inquiry was made without any prejudice to Sahara, as their petition contesting the land reclamation is currently under review. The next hearing is scheduled for January 19.

The bench, comprising Justices Rajan Roy and AK Chaudhary, issued the order in response to a Public Interest Litigation (PIL) filed in 2008 by Gomtinagar Jan Kalyan Mahasamiti.

During the hearing, the petitioner’s attorney, BK Singh, informed the court that the land previously held by Sahara has been reclaimed by LDA and LMC. He stated that the entire area is designated as a green belt in the master plan, arguing that it is unclear how LDA and LMC intend to handle it.

Sahara’s attorney, Piyush Agrawal, opposed this claim, asserting that not all the land is designated as a green belt. He also noted that Sahara has filed a writ petition against the orders permitting the reclamation, which is still pending.

The bench linked the PIL to Sahara’s petitions, stating, “Without prejudice to Sahara’s rights, LDA and LMC counsel should seek instructions based on the information provided by the PIL petitioner’s attorney and assist the court at the next session.”
