NOIDA: The district consumer commission has found Supertech Limited guilty of service deficiency after a flat sold by the builder at Ecovillage-2 suffered from seepage and sewage issues. The commission has instructed the company to address the defects within 30 days and compensate the owner with Rs 4,000 for mental anguish and legal expenses.
The complaint was initiated in May 2019 by Minimol Chanchal Singh, a resident of Sector 16B, who had purchased a flat in Tower C-3 of the Supertech condominium. The flat, which was allotted to Singh in September 2016, was sold for Rs 27 lakh, including registry charges.
Singh informed the commission that dirty sewer water and dampness began accumulating in the flat from September 30, 2016. Despite numerous requests to the builder for repairs, no action was taken. She also stated that a maintenance agency, which charged Rs 3,223 per month, failed to resolve the issues, including a promised pipeline disconnection and the installation of a sewage treatment plant. Singh argued that the flats were sold prior to the completion of construction.
Supertech denied these allegations, claiming the flat was allotted to Singh’s husband, Chanchal Singh Mahapatra, who took possession to his satisfaction, after which a lease deed was executed. The builder’s counsel argued that maintenance issues were governed by a separate agreement between Supertech Estate Private Limited and the maintenance agency, implying that the complaint should be directed at the agency, not the developer.
The commission dismissed this argument, noting that Supertech had arranged the maintenance agreement and that Supertech Estates Pvt Ltd acted as the maintenance agency. The deficiencies were only discovered after the complainant had lived in the flat for three years, which did not absolve the builder of responsibility. Accordingly, the commission ordered Supertech Limited, through its chairman and managing director, to resolve the grievances within 30 days.
