LUCKNOW: The Allahabad High Court has declined to hear a petition from Sahara India Commercial Corporation Limited challenging the Lucknow Municipal Corporation’s September 2025 orders that annulled the land lease for the Sahara Shahar complex and mandated its vacation.
The HC’s Lucknow bench stated that the petition was not maintainable since the matter involving Sahara Shahar is currently under consideration in the Supreme Court, where Sahara has filed an application, and the Lucknow Municipal Corporation (LMC) has submitted an objection.
“We find ourselves constrained from proceeding further in this matter,” remarked a bench of Justices Rajan Roy and Manjive Shukla as they dismissed the petition submitted by M/s Sahara India Commercial Corporation Limited on April 22.
The petitioner contested the LMC’s order dated September 8, 2025, which canceled the land lease granted to Sahara on October 22, 1994, and the subsequent order from September 11, 2025, directing the land to be vacated.
The petitioner argued that an arbitration award favoring them regarding this land was issued on September 2, 2017, but the LMC disregarded it and incorrectly annulled the lease. Sahara expressed a willingness to pay the required fees to extend the lease, while the LMC opposed the petition.
During the hearing, the bench noted that contempt petitions are pending against the Sahara Group in the Supreme Court relating to a prior order in the Sahara SEBI dispute.
In this case, Sahara submitted an application to the Supreme Court on September 14, 2025, requesting permission to transfer several properties to the Adani Group to facilitate compliance with the Supreme Court order by depositing the funds into the Sahara SEBI account from this transaction.
The bench discovered that Sahara Sahar was included in the properties designated for transfer to the Adani Group.
With Sahara’s petition currently being reviewed in the Supreme Court, along with interim orders issued on various dates, the bench concluded that there was no basis to consider the present plea separately.
