NEW DELHI: The Uttar Pradesh Real Estate Regulatory Authority (UP-RERA) has levied a fine of ₹2.43 crore on two Lucknow-based promoters for their repeated failure to upload mandatory quarterly progress reports (QPR) of their registered projects on the authority’s web portal.
In one instance, promoter Shushil Kumar Katiyar of the Arpita Infinity project has faced penalties. This project, registered with a start date of July 10, 2024, and an expected completion by January 31, 2027, did not adhere to uploading the necessary progress reports despite receiving multiple notices from UP-RERA. Consequently, the authority sanctioned a fine of ₹16.25 lakh, which is five percent of the project cost of ₹3.25 crore.
In another case, Ganpati Infrastructure Development Company, associated with the Ganpati Smart City project, also violated the same requirement. This project began on September 30, 2024, with an expected completion on October 24, 2026, but failed to update its QPR as well. The authority determined a penalty of ₹2.27 crore, equating to five percent of the project cost of ₹45.45 crore.
According to Section 11(1) of the Real Estate (Regulation and Development) Act, 2016, all promoters are required to regularly update project details on the authority’s website after each quarter. This includes information on booked units, garage statuses, approvals, and overall project progress.
Furthermore, Rule 14(1)(a) of the Uttar Pradesh RERA mandates that promoters upload quarterly updates within seven days after each quarter ends. Non-compliance with these guidelines constitutes a violation, leading to penalties under Section 61 of the RERA Act, which permits fines up to five percent of the project cost.
Sanjay Bhoosreddy, chairman of UP-RERA, emphasized, “Timely QPR updates are a statutory obligation and crucial for transparency in project development. Promoters neglecting RERA provisions will face stringent actions, including fines and other enforcement measures.”
The authority has instructed both promoters to submit the fines via bank draft in favor of UP-RERA, Lucknow, within 15 days and to ensure the uploading of all pending QPRs on the portal within the same timeframe.
