HYDERABAD: The Telangana Real Estate Regulatory Authority (TGRERA) has mandated Aliens Developers Pvt Ltd to refund ₹2,00,000 to a homebuyer, Bakki Sneha of Karwan, within 30 days. This amount reflects the remaining balance of a booking advance for a flat in the ‘Aliens Space Station’ project located in Tellapur, Sangareddy district.
As per the order issued on Wednesday, Sneha had initially booked a flat in the project, paying ₹2.5 lakh on May 31, 2020. However, after cancelling her booking, she only received ₹50,000 as a partial refund in October 2022. Despite her repeated requests, the remaining amount of ₹2 lakh was not refunded.
Aliens Developers contended that Sneha lost her allottee status under the Real Estate (Regulation and Development) Act, 2016, after she voluntarily cancelled her booking. The company argued that the entire amount was refunded already and maintained that the dispute was contractual, thereby falling outside RERA’s jurisdiction.
In contrast, the Authority determined that the complainant maintained her allottee status. It pointed out that the deed lacked a date of execution and evidence confirming valid execution by both parties. Referencing a previous case, the tribunal dismissed the developer’s arguments and ordered the refund of the outstanding ₹2 lakh within 30 days in accordance with Sections 37 and 38 of the Act.
The order further noted that failure to comply would result in penalties as outlined in Section 63 of the Real Estate (Regulation and Development) Act, 2016. No costs were awarded in this case.
Though the complainant requested interest at 6% per annum, the Authority declined, citing insufficient proof for the cancellation’s cause. The respondent submitted a copy of a ₹2,00,000 cheque dated July 30, 2025, but did not provide evidence of its encashment.
