52% of Pune Housing Societies Don’t Have Legal Land Ownership

PUNE: Over half of the cooperative housing societies in the city lack legal ownership of the land they occupy, a significant issue that hinders redevelopment and restricts property rights. According to the state cooperative department, 52%—or 11,956 out of 22,955 registered societies—have not received their conveyance or deemed conveyance deeds. A conveyance deed is the conclusive legal document that transfers land ownership from the developer to the housing society. Bombay HC Approves Vienna Apartments’ Housing Society Formation

MUMBAI: The Bombay High Court has permitted the registration of the Vienna Apartments Co-operative Housing Society in Juhu, overturning a state government decision from June 2021 that had prevented it. Justice Amit Borkar determined that the previous refusal was legally flawed and not aligned with the aims of homebuyer protection laws, including the Maharashtra Ownership Flats Act (MOFA) and the Maharashtra Co-operative Societies Act (MCS Act).
