NEW DELHI: The Supreme Court labeled the encroachments on lands acquired for the Rajasthan Housing Board as an “absolute rank scam,” with allegations of collusion at all levels.
Justices Vikram Nath and Sandeep Mehta noted that multiple Rajasthan High Court rulings had established that authorities cannot regularize these illegal constructions.
“Several benches have attempted to ensure the land is reclaimed, but the influential individuals behind this scam prevent it,” stated Justice Mehta.
This commentary came during a hearing on a plea from the Rajasthan government, which was contesting an August 20 high court order.
The high court had suspended a government order from March 12, 2025, aimed at regularizing illegal colonies on the acquired land and required the demolition of encroachments, along with action against responsible officials.
During the proceedings, Additional Solicitor General Aishwarya Bhati, representing Rajasthan, pointed to the high court’s findings, revealing approximately 5,000 houses in question.
“The high court has taken serious note of this,” remarked Justice Mehta.
The bench urged the state to consider the demolition of these unauthorized structures.
“Explain in court. This is an unequivocal scam. Dozens of prior high court orders have stated that regularization of these constructions is not permissible; the land belongs to the housing board, and collusion exists from top to bottom,” they asserted.
Justice Mehta emphasized, “This is an absolute gospel truth. You’d better take instructions; otherwise, we will continue this from here and ensure everything is demolished.”
The bench described the scope of the scam as overwhelming, noting widespread encroachment by land grabbers and property dealers in relation to the housing board’s land.
They stated, “If you wish to withdraw, we can permit that. Alternatively, we can begin monitoring this ourselves,” addressing Bhati.
The bench allowed the state to withdraw its plea while retaining the right to seek appropriate relief from the high court.
