NGT Requests New Report on Illegal Noida Buildings


NOIDA: The National Green Tribunal has expressed concern over the Noida Authority’s inadequate response to issues of illegal residential and commercial constructions.

The tribunal, led by Justice Prakash Srivastava on July 28, has ordered the Authority to provide a new affidavit within three weeks detailing individuals, properties, projects, and their specific locations.

The projects identified by the petitioner’s lawyer, Akash Vashishtha, include Pristine Greens and Krishna Elite Homes in Bisrakh Jalalpur village, Greater Noida West, which are being developed on agricultural and residential land. Other projects named include Trinity High Street in Jalpura, Vihaan Heritage in Bisrakh, Subodh Bhati Market in Aimnabad, Samtel Enclave/Dwarka City on GT Road, Greater Noida, and the Kiwood Decor shopping center near Lotus Villa in Jalpura.

Similar directives were issued to the Greater Noida Authority, the Noida district magistrate, and the groundwater management council. This case is being heard as Original Application (OA) 328 of 2024, filed by former municipal corporator Rajendra Tyagi, requesting action against builders for converting agricultural land and proceeding with construction without the necessary environmental clearances.

The tribunal noted, “We have reviewed the photographs included with the affidavit, most of which are outdated, dating back to November 2022, prior to the filing of this application. Therefore, Noida has not provided a clear overview of the illegal constructions violating environmental regulations.”

Vashishtha remarked that despite the tribunal issuing specific orders on two previous occasions, the authorities have not taken appropriate action. “Despite directives from this tribunal on December 9, 2024, and March 27, 2025, substantial illegal construction continues in areas like Chhipyana, Roja, Roja Jalalpur, Sadullapur, Vaidpura, Saini, Kheri Bhanauta, Sunpura, and Patwadi,” he stated.

Vashishtha provided photographs representing the ongoing alleged illegal construction, indicating that these were supposed to be verified by the UP Pollution Control Board, which should have taken action.

He accused authorities of collusion with real estate developers engaged in illegal construction, highlighting concerns about the impending chaos when projects are handed over to customers, followed by demolition orders from the authorities.

“Builders and agents are in a rush to sell these properties. To portray legality, they have secured electricity connections and built RCC roads,” Vashishtha said, advocating for the establishment of a committee under tribunal supervision to compile an on-ground report.

The petition lists 56 villages in Greater Noida and 18 villages in Noida, among others, where unauthorized colonies and townships are emerging in violation of the Air Act and Water Act.
