NOIDA: A city court has instructed the police to file a case against the directors of Sikka Pinnacle Super Structure Pvt Ltd and three senior staff members for allegedly defrauding a homebuyer of ₹79 lakh. The issue arose after the company failed to deliver a flat booked in 2022 and subsequently sold it to another buyer.
As a result of the court’s order, Sector 113 police registered an FIR against the company’s directors, Harvinder Singh Sikka and Gurneet Singh Sikka, along with senior officials Gurleen Kaur (CRM head), Rajiv Sharma (marketing head), and Himanshu Jain (project head), as well as Chandramani Devi, who allegedly bought the same unit. They have been charged under IPC sections 420 (cheating), 323 (criminal breach of trust), 504 (assault), and 506 (criminal intimidation).
The complainant, Amit Prasad Rai, residing in Sector 73, reported that he had booked a flat in the Sikka Kimaantra Greens Project in Sector 79 and sought a home loan. However, banks refused his application due to the project’s expired RERA registration. After receiving assurance from the builder that the flat would be delivered by November 2023, he transferred ₹28.5 lakh to the company’s IndusInd Bank account.
Shortly thereafter, Rai received an email from the company stating they could not sell him the flat. Upon confronting the staff, they dismissed it as an error, claiming the project’s RERA registration had been renewed. Trusting their word, Rai applied for another loan and paid an additional ₹51.3 lakh.
Rai stated, “Despite repeated follow-ups, they neither delivered the flat nor refunded my money.” He accuses the builder’s officials of colluding to defraud him, leaving him to pay both rent and EMIs on the loan.
During a site visit earlier this year, Rai and his wife discovered that the same unit had been sold to another buyer, Chandramani Devi, who is a resident of Lotus Boulevard Society in Sector 100. When he confronted project head Himanshu Jain, he allegedly contacted the company directors, who verbally abused, assaulted, and threatened him.
“They claimed they had strong political connections and warned me against pursuing legal action,” Rai said in his complaint.
