Court Denies HDIL Promoter Trip to Hyderabad, Allows Other Travel


MUMBAI: A special PMLA court has denied HDIL promoter Sarang Wadhawan’s request to travel to Hyderabad, where he is under investigation for allegedly facilitating threats via another individual. Wadhawan is implicated in a Rs 6,117.9 crore money laundering case.

“A complaint has been filed with the ED (Enforcement Directorate) concerning threats involving the accused, and verification of the allegations is ongoing. Given the situation, allowing the applicant to visit Hyderabad is neither just nor appropriate,” stated Special Judge R B Rote. Wadhawan, who was released on bail last year after being arrested four years ago alongside his father, Rakesh Wadhawan, in the PMC Bank scam, sought permission to travel for a change of scenery with his children.

While travel to Hyderabad was denied, the court permitted Wadhawan to visit other locations, including Tamil Nadu, Goa, and Uttarakhand for religious purposes, as well as NCR for legal consultations, noting no complaints related to these areas. “Travel is a fundamental right under the Constitution of India. The applicant wished to travel within specified dates, and granting such permission wouldn’t cause any prejudice,” the judge remarked.

In his application, Wadhawan expressed his intent to visit NCR for legal matters and journey to Goa and Tamil Nadu with his children to explore religious sites. The prosecution opposed this request, citing Wadhawan’s status as a primary suspect and potential risks of evidence tampering or fleeing due to the nature of the charges, which involve substantial public funds.

The judge allowed travel between August 25 and September 25, excluding Hyderabad, stating, “Considering the purpose of travel and the time before the trial begins, the applicant is entitled to travel under certain conditions.” He must provide a detailed itinerary, including contact information, to the investigating officer. He should maintain his current security deposit, or, if withdrawn, deposit a new amount of Rs 1 lakh.

Wadhawan is prohibited from tampering with property or influencing witnesses while traveling. Upon returning to Maharashtra, he must report to both the investigating officer and the court immediately. If the investigating officer requires his presence during his travels, he must return promptly. Authorities have been instructed to report any suspicious behavior from him without delay.
