Consumer Forum Holds Parsvanath Liable for Flat Delay


NEW DELHI: The Delhi State Consumer Disputes Redressal Commission has found Parsvanath Developers Limited at fault for inadequate service and unfair trade practices due to a significant delay in delivering a residential flat booked in 2007.

Last month, the bench comprising Justice Sangita Dhingra Sehgal (president) and Pinki (judicial member) ordered Parsvanath Developers to immediately hand over the flat and compensate the complainants with a total of Rs 5.5 lakh.

The complainants, Nitin Bansal and Amita Bansal, purchased a 3BHK flat from Parsvanath for Rs 27.68 lakh, following a construction-linked payment plan. They signed the flat buyer agreement on April 19, 2007, with assurance of possession within 30 months plus a 6-month grace period from the construction start date.

Despite having paid Rs 26.93 lakh, the buyers were denied possession and left without information regarding area increases (120 sq ft), parking, VAT, or final registration specifics. Following unsuccessful attempts to resolve the issue, they escalated the matter by filing a complaint.

The commission cited the Supreme Court ruling in Arifur Rahman Khan vs DLF Southern Homes (2020), where it was established that failing to provide possession of property within the agreed timeline amounted to inadequate service.

The commission mandated the immediate transfer of possession, along with a payment of Rs 4,00,000 for the delay, Rs 1,00,000 for the emotional distress caused, and Rs 50,000 in litigation costs. If Parsvanath Developers defaults, they are required to refund the full amount with interest at 9% per annum from December 12, 2014, until the sum is realized.
