MUMBAI: The Bombay High Court has postponed the hearing for pre-arrest bail filed by builder Bhavesh Sanghrajka to November 27. This plea is related to an FIR alleging culpable homicide not amounting to murder, following the death of a 22-year-old woman caused by a cement block that fell from his construction site in Jogeshwari. The prosecutor informed the court that no action will be taken until the next hearing.
Justice N R Borkar remarked that additional public prosecutor BV Holambe-Patil is requesting more time to present a report from an expert regarding the safety measures taken at the site.
Sanghrajka, represented by counsel Niranjan Mundargi, denied any negligence, asserting that safety protocols were in place. He highlighted his “unblemished professional reputation” over two decades and claimed that the FIR lacks “legal, cogent, trustworthy or reliable material.”
The sessions court had previously denied Sanghrajka’s anticipatory bail request, prompting him to approach the higher judiciary, where he stated that he was not present at the site when the incident—deemed an “accident”—occurred on October 8.
According to the FIR, the young woman left home around 9:30 AM, and witnesses reported that a white cement block fell from above. Police arrested two co-accused on October 11. Sanghrajka’s application described the FIR as “illegal, baseless, and devoid of facts and law,” claiming it constitutes a “misuse of the legal process and infringement of liberty.”
