Bengaluru: Illegal Construction Persists in HAL III Despite HC Order

BENGALURU: Members of the HAL III Stage Taxpayers and Residents Association have expressed frustration over ongoing illegal constructions that violate local building norms. The association has contacted relevant authorities over 40 times since February 2025 to demand action but has yet to receive a reply.

In light of what they describe as indifference from Bruhat Bengaluru City Corporation (BBCC) officials, the association has filed a writ petition in the High Court.

During the hearing, the court instructed the BBCC Assistant Executive Engineer to issue notices to M/s Moonlight FNB Pvt Ltd regarding compliance with the sanctioned construction plan. The court further mandated that any construction not adhering to approval be halted immediately, potentially with police assistance.

Residents contend that BBCC has failed to enforce the High Court’s orders, noting ongoing construction and the imminent opening of the building despite clear violations.

“The construction infringes on setback regulations and is a significant disturbance. As a senior citizen recovering from knee surgery, I struggle to sleep amid ongoing work. The thought of a bar and restaurant opening nearby is alarming,” said Lata, a neighboring resident who also pointed out the building’s inadequate parking space.

Meenakshi Prabhu, Secretary of the HAL III Stage Taxpayers and Residents Association, reiterated that multiple authorities had been notified of the building violations. “Despite meeting with officials no solutions have been implemented. BBCC engineers have not inspected the site or directed the property owner to cease work,” she emphasized.

The government says citizens groups must remain active and vigilant. We urge the government to enforce the laws and protect us residents.

Dr. Kiran M, the President of the HAL III Stage Taxpayers Association, echoed these grievances, stating that the construction blatantly disregards setback standards and yet remains unaddressed despite their repeated pleas. “We received a stay order, but work continues. The building accommodates around 300 people but lacks parking and is perilously close to a school, posing potential risks for children,” he noted.

Dr. Kiran also raised safety issues, particularly affecting senior residents in the vicinity. “An eight-foot glass wall has been erected. In case of a fire, it could jeopardize residents’ lives and those in nearby buildings,” he warned, appealing to the government to enforce regulations and safeguard residents.

A BBCC Executive Engineer asserted that construction has been halted in alignment with the court’s directions. “I visited the site on Wednesday and ordered the workers to stop,” he confirmed.
