SC Limits Activity on 100 Acres of Disputed Shamshabad Land


HYDERABAD: The Supreme Court has instructed private parties claiming a significant 100-acre disputed parcel in Shamshabad and Paigah village, allegedly owned by HMDA, to halt any construction or transfer of property until their appeal is resolved in the Telangana high court.

The division bench, comprising Justices MM Sundresh and Satish Chandra Sharma, was reviewing a petition from Mohammad Taher Khan, who claims ownership of the land based on specific survey numbers. HMDA (formerly HUDA) argued it had acquired approximately 180 acres in the 1990s, and that when objections arose over the increased compensation amounts, the Supreme Court mandated an enhancement in 2009.

In his appeal to the Telangana HC, Taher Khan stated that Justice ND Patnaik of the then unified Andhra Pradesh HC issued orders favoring private parties in April 1988. However, the division bench noted that Justice Patnaik was elevated to the bench only in December 1988 and could not have rendered a decision in April of that year.

In April 2025, the Telangana HC found that one of the judicial orders presented by Taher Khan was forged, leading the Charminar police to open a criminal investigation against him. The court also required the government to form a special investigation team for further inquiry and maintained status quo until the appeal is concluded.

Following the registration of the FIR, and while the appeal was still pending, Taher Khan sought intervention from the Supreme Court to overturn the HC’s stay orders. The Supreme Court, however, denied his request, reiterating that no construction or transfer of the land should occur until the Telangana HC resolves the case.
