NEW DELHI: The Ministry of Housing and Urban Affairs (MoHUA) has recommended that state real estate regulatory authorities consider allowing a four-month extension for the registration and completion timelines of registered real estate projects impacted by the ongoing situation in West Asia.
This advisory specifically pertains to projects whose completion date, revised completion date, or extended completion date is on or after February 28, 2026.
MoHUA stated that it has received feedback from stakeholders in the real estate sector about the adverse effects of the West Asia situation on global supply chains, leading to shortages of construction materials and hindering the timely execution of real estate projects.
The ministry referenced an Office Memorandum issued by the Department of Expenditure, Ministry of Finance, on April 29, 2026, which classified the ongoing West Asia situation as “war” for invoking the force majeure clause.
According to Section 6 of the Real Estate (Regulation and Development) Act, 2016, an extension of project registration is allowable in cases of force majeure, including wars, which affect regular project development.
The advisory also highlighted Section 7(3) of RERA, which allows a real estate regulatory authority to keep a project registration intact instead of revoking it, under terms and conditions deemed suitable for the benefit of allottees.
MoHUA mentioned that regulatory authorities may issue appropriate orders or directions to extend the registration and corresponding completion timelines for eligible registered real estate projects by four months.
The ministry advised that state RERAs may issue a unified order to streamline the process, preventing the need for separate applications for each project extension.
Parveen Jain, president of NAREDCO, explained that the current geopolitical conditions in West Asia have disrupted the availability and cost of construction materials, leading to unavoidable delays in project execution.
Jain added that timely extensions for project registration and completion timelines would provide developers with relief for circumstances beyond their control while also protecting homebuyers, allowing projects to finish in an orderly manner.
NAREDCO has urged all state RERA authorities to act promptly on this advisory to offer developers relief from delays caused by the geopolitical situation.
