HYDERABAD: A villa owner in a gated community near Kompally has filed a police report claiming her property was unlawfully mortgaged by the builder in October 2025, falsely presenting it as unsold. The Medchal police have opened a case against the real estate developer and the private firm that allegedly provided a loan based on this mortgage.
The complainant, Anitha Vittal, who is a senior corporate executive, alleged that numerous other properties developed by the builder, including a venture for senior citizens, were also mortgaged without consent in the same deed to secure loans in 2025.
Anitha discovered the fraud when she sought to check the encumbrance on her property, only to find it was mortgaged without her knowledge. “While obtaining the Encumbrance Certificate (EC) for my villa, I found a memorandum of deposit of title deeds dated October 16, 2025, showing my villa mortgaged to a private firm. Upon verification, I confirmed that my villa and other properties were mortgaged without our knowledge,” she stated in her police report.
She urged law enforcement to take appropriate legal steps against those responsible for this fraudulent act. Anitha purchased the villa and registered it in her name at the Medchal sub-registrar office on August 24, 2020. “We also received a no dues certificate from the accused company on November 6, 2020. However, they fraudulently presented my villa as unsold to secure massive loans,” she explained.
In response to her complaint, Medchal police registered a case under Sections 316(2) (criminal breach of trust), 318(4) (cheating), and 3(5) (common intention) of the Bharatiya Nyaya Sanhita (BNS) on May 5 against the involved real estate and private loan firms.
Medchal police reported that to date, two property owners have come forward with similar claims against the builder. “We have initiated a case based on one complaint and sent notices to both companies, awaiting their responses,” stated Medchal Inspector A. Satyanarayana.
