SC Issues Notice on Contempt Petition Over Gurugram Constructions


GURUGRAM: The Supreme Court has issued a notice in a contempt petition filed by Rajdarbar Iconic Venture concerning its December 17, 2024, ruling on unauthorized constructions, focusing on a land parcel in Chakkarpur village.

During the contempt petition hearing on April 17, a bench comprising Justices JB Pardiwala and Vijay Bishnoi acknowledged the delay in filing the petition and instructed the respondents, including Anurag Rastogi and others, to submit their replies by May 7, 2026. The court also waived the requirement for their personal appearance at this stage.

The petition names several respondents, including high-ranking Haryana officials such as the chief secretary, officers from the town and country planning department, HSVP, MCG, Dakshin Haryana Bijli Vitran Nigam, as well as private individuals.

This contempt plea stems from the Supreme Court’s previous ruling in 2024, which established guidelines for regulating construction activities and ensuring adherence to approved plans. It emphasized that building completion or occupation certificates must be secured before essential public services like electricity, water supply, and sewage connections are provided. Furthermore, it ruled that permits for commercial activities should not be issued for properties that do not comply with sanctioned plans.

In this current petition, the company cites a 1.39-acre land parcel in the Chakkarpur revenue estate in Gurgaon. They mentioned that following the December 2024 judgment, they submitted requests to the relevant authorities, urging compliance with the court’s directives.

The petition specifies that these communications occurred between December 2024 and January 2025, requesting the implementation of the court’s framework. It also noted that notices were dispatched to the concerned authorities for enforcing the court’s orders, yet no responses were received.

The matter is now under the Supreme Court’s contempt jurisdiction, with the court awaiting responses from the respondents. Further proceedings will take place once the replies are submitted.

This case highlights the importance of enforcing judicial directives regarding building regulations and urban development, particularly in rapidly growing urban areas like Gurgaon.
