Noida Builder Owes ₹1.8 Crore; Shivalik Homes Buyers Wait 10 Years



NOIDA: Over 350 homebuyers at Shivalik Homes in Greater Noida’s Surajpur have been waiting for more than a decade for paperwork confirming their ownership. Families have moved in over the years, yet property registries have remained inactive due to the developer’s outstanding lease rent dues of around ₹1.8 crore and failure to provide essential documents for occupancy and completion certificates.

The project, managed by Cosmos Infraestate Private Limited and initiated in 2010, consists of four residential towers. Residents reported receiving fit-out possession in phases—Tower D in 2015, Tower B in 2016, and Towers A and C in 2017. However, necessary certificates and registries were never issued, placing residents in a state of uncertainty despite their years of residence.

Cosmos is obligated to pay lease rent to the UP State Industrial Development Authority (UPSIDA), which has stated that registries and deeds will only be processed following the issuance of the completion certificate.

Records from UPSIDA show that over 15 formal notices have been sent to Cosmos between 2020 and 2025 concerning the unpaid dues.

On December 16 of last year, UPSIDA requested the district magistrate to recover the overdue amount as government arrears. Consequently, the Dadri tehsildar issued a recovery certificate against the developer.

As the amount remains unpaid and essential documents are still pending, UPSIDA took action on December 17, 2025, sealing nine unsold flats in the development. An additional order has since prohibited the sale and purchase of these units. Himanshu Shekhar Jha, a resident who filed a complaint on the government’s IGRS portal regarding the delays, noted that a review meeting took place on January 12 of this year. The developer assured officials that all outstanding land dues would be cleared and necessary OC-CC documents submitted by March.

Residents expressed that the lack of completion certificates and registered sale deeds has led to significant financial and legal difficulties, notably in obtaining bank loans, selling flats, or gaining civic approvals. Many have raised concerns about how possession was granted without required clearances.

Jha expressed skepticism over the developer’s latest promise. “They’ve been making commitments for years but haven’t paid the required dues for registries,” he stated.

In response to inquiries, Arvind Kumar Singh, a manager at Cosmos Infraestate, stated the company is collaborating with UPSIDA to address the issue. He alleged there were technical discrepancies in the dues calculation, claiming the outstanding amount was initially over ₹80 lakh and that discussions are ongoing to resolve the matter and initiate registries promptly.
